2025-ൽ ഭേദഗതി ചെയ്ത പുതിയ വഖഫ് നിയമം അനുസരിച്ച് ബോർഡുകളിൽ രണ്ടു മുസ്ലിം ഇതര പ്രതിനിധികളെ ഉൾപ്പെടുത്തുന്നത് നിർബന്ധമാക്കിയിട്ടുണ്ട്. മുനമ്പം പോലുള്ള നിർണായക തർക്കഭൂമികളിലെ പ്രശ്നങ്ങൾ ഉൾപ്പെടെ ഉയർത്തിക്കാട്ടിയാണ് പുതിയ നിയമത്തിന് അനുകൂലമായി സുപ്രധാന ഹർജികൾ സമർപ്പിക്കപ്പെട്ടത്.
Under the newly amended Waqf Act of 2025, nomination of non-Muslim members to state boards was made compulsory. This became highly controversial amid the dispute over coastal Munambam land claims, which prompted public interest litigation.

കൊച്ചി, ജൂലൈ 15: സംസ്ഥാന വഖഫ് ബോർഡിന്റെ നിലവിലെ രൂപീകരണവുമായി ബന്ധപ്പെട്ട നിയമ തർക്കങ്ങളിൽ അന്തിമ തീരുമാനമുണ്ടാകുന്നതുവരെ യാതൊരുവിധ നിർണായക തീരുമാനങ്ങളും കൈക്കൊള്ളരുതെന്ന് ഹൈക്കോടതി ഉത്തരവിട്ടു. പുതിയ വഖഫ് മാനേജ്മെന്റ് നിയമത്തിലെ പ്രധാന വ്യവസ്ഥകൾ ലംഘിക്കപ്പെട്ടുവെന്ന് ചൂണ്ടിക്കാട്ടിയുള്ള ഇടക്കാല ഉത്തരവിലാണ് ഹൈക്കോടതി ഈ വിലക്ക് ഏർപ്പെടുത്തിയത്. വിശദമായ കോടതി വിധി പകർപ്പ് ഉടൻ പുറത്തിറങ്ങും.
1995-ലെ ഏകീകൃത വഖഫ് മാനേജ്മെന്റ്, ശാക്തീകരണം, കാര്യക്ഷമത, വികസന നിയമത്തിലെ സെക്ഷൻ 14 പ്രകാരം രണ്ട് മുസ്ലിം ഇതര പ്രതിനിധികളെയും ഒരു ഷിയാ പ്രതിനിധിയെയും ഉൾപ്പെടുത്തി ഭരണസമിതി പുനഃസംഘടിപ്പിക്കേണ്ടതായിരുന്നു. എന്നാൽ ഇത് പൂർണ്ണമായും അവഗണിച്ചാണ് നിലവിലെ ബോർഡ് പ്രവർത്തിക്കുന്നതെന്ന് കോടതി കണ്ടെത്തി.
ചീഫ് ജസ്റ്റിസ് സൗമൻ സെൻ, ജസ്റ്റിസ് ശ്യാം കുമാർ വി.എം. എന്നിവരടങ്ങിയ ഡിവിഷൻ ബെഞ്ചാണ് ഇടക്കാല ഉത്തരവ് പാസാക്കിയത്. ബോർഡിന്റെ ഘടന നിലവിലെ നിയമാവലി പ്രകാരമല്ലെന്ന് പ്രഥമദൃഷ്ട്യാ വ്യക്തമാണെന്ന് കോടതി നിരീക്ഷിച്ചു.
അഡ്വക്കേറ്റ് ജനറൽ ജാജു ബാബു, അഡീഷണൽ സോളിസിറ്റർ ജനറൽ പി. ശ്രീകുമാർ, സീനിയർ അഡ്വക്കേറ്റ് ടി. കൃഷ്ണനുണ്ണി എന്നിവർ വിവിധ കക്ഷികൾക്കായി കോടതിയിൽ ഹാജരായി വിശദമായ വാദങ്ങൾ മുന്നോട്ടുവെച്ചു. നിലവിലെ ഘടനയിലെ പിഴവുകൾ അഡ്വക്കേറ്റ് ജനറൽ കോടതിയിൽ തുറന്നുസമ്മതിച്ചു.
സംസ്ഥാന സർക്കാരിന്റെ കക്ഷി നിലപാട് ആരാഞ്ഞ ജസ്റ്റിസ് സെൻ ചോദിച്ചു: “നിയമപരമായ പൊരുത്തക്കേടുകൾ ഉണ്ടെന്ന് സംസ്ഥാന സർക്കാർ സമ്മതിക്കുന്നുണ്ടോ?” ഇതിന് അഡ്വക്കേറ്റ് ജനറൽ “അതെ, ഘടനയിലെ അപാകതകൾ ഞങ്ങൾ പരോക്ഷമായി സമ്മതിക്കുന്നു” എന്ന് മറുപടി നൽകി.
ആക്ട്സ് (ACTS) എന്ന സംഘടനയ്ക്കായി കോടതിയിലെത്തിയ അഡ്വക്കേറ്റ് ലക്ഷ്മി ശ്രീധർ ഉൾപ്പെടെയുള്ളവർ മുനമ്പം ഭൂമി സംബന്ധിച്ച വിവാദം ചൂണ്ടിക്കാട്ടി. മുനമ്പത്തെ വിവാദഭൂമി വിശദാംശങ്ങൾ ബോർഡ് യു.എം.ഇ.ഇ.ഡി (UMEED) പോർട്ടലിൽ അപ്ലോഡ് ചെയ്തത് അവിടുത്തെ സാധാരണക്കാരായ ജനങ്ങളെ പ്രതികൂലമായി ബാധിക്കുമെന്ന് അവർ ബോധിപ്പിച്ചു.
കൂടാതെ, സിപിഐ(എം) പ്രമുഖ നേതാവ് കുഞ്ഞഹമ്മദ് കുട്ടി മാസ്റ്ററുടെ വഖഫ് ബോർഡിലെ നിയമനവും ഹർജിയിലൂടെ ചോദ്യം ചെയ്യപ്പെട്ടിട്ടുണ്ട്. അമുസ്ലിം നാമനിർദ്ദേശങ്ങളിൽ ഉണ്ടായ കാലതാമസം കോടതിയുടെ കടുത്ത അതൃപ്തിക്ക് കാരണമായി. ഒരു വാരത്തിന് ശേഷം ഈ കേസുകൾ വീണ്ടും വാദം കേൾക്കും.
KOCHI, July 15: The Kerala High Court on Wednesday passed a crucial interim order restraining the State Waqf Board from taking any major decisions or incurring capital expenditure until controversies surrounding its constitution are fully resolved.
A Division Bench comprising Chief Justice Soumen Sen and Justice Syam Kumar V.M. prima facie found that the current Board composition does not conform with Section 14 of the Unified Waqf Management, Empowerment, Efficiency, and Development Act 1995, due to the glaring absence of two non-Muslim members and one Shia member.
The High Court’s ruling came across four separate public interest litigations challenging the Board. Advocates presented arguments before the bench, with Advocate General Jaju Babu admitting that “certain infirmities with respect to the Board’s present constitution” indeed exist.
Addressing the State’s stance, Justice Sen remarked: “So the stand of the State is to reconstitute the Board in accordance with Section 14?… Impliedly, you accept that the Board has not been properly constituted?” to which the AG responded in the affirmative.
Senior Counsel T. Krishnanunni, appearing for the Board, requested additional time and submitted that the vacancy of the two non-Muslim nominations remained unfulfilled because related cases were pending before the Supreme Court. However, ASGI P. Sreekumar and the petitioners refuted this assertion.
One of the central PILs was filed by the Christian charitable organization, Assembly of Christian Trust Services (ACTS), which also opposed the upload of details of the disputed coastal Munambam land to the Union Government’s UMEED Portal. They claimed that this direct action by the board impacts thousands of Hindu and Christian families residing on the peninsula.
Another PIL moved by BJP Leader Shone George sought immediate judicial orders directing the State to nominate the non-Muslim representatives. Additional grievances cited in the cases included the political nomination of CPI(M) leader Kunhammed Kutty Master to the Waqf board.
The Court has directed the State’s Joint Secretary of the department dealing with Waqf matters to oversee the operations for the time being, scheduling the next detailed hearing in one week.

“If two non-Muslims are not nominated, then prima facie, that only will not allow you to function. For the time being, maybe an administrator, if it is there, who shall function till this issue is resolved. No major decision could be taken.”
ഹൈക്കോടതിയുടെ ഈ നടപടി തികച്ചും ന്യായമാണ്. മതപരമായ ബോർഡുകളിലും ഭേദഗതി വരുത്തിയ നിയമവ്യവസ്ഥകൾ വേഗത്തിൽ നടപ്പിലാക്കണം.
The High Court’s intervention is absolutely just. Amended regulations should be strictly followed even in religious administration boards.
