Nowadays news reports about road accidents seldom catch the attention of newspaper readers. A stage has reached where the general public consider motor vehicle accidents, leading to casualties, the order of the day. Right from the occurrence, things will move on as a routine course with the injured or the dependents of those who lost life ultimately getting a claim award from the MACT after several years.
Among the scores of road accidents occurring every day, there is a rare category of cases which are not given proper attention by the law enforcers, legal practitioners, and even to a certain extent, by Courts. Those are the hit and run cases where the offending vehicle and the culprits on wheels manage to escape from being caught notwithstanding the fact that there are CCTV cameras of shops and other establishments in almost every nook and corner of our roads.
As matter stands now, the victims of such accidents bear the brunt of the treatment expenses, loss of earnings and devastated health since there is no effective implementation of the scheme by name ‘Compensation to Victims of Hit and Run Motor Accidents Scheme, 2021’ made under Section 161 of the Motor Vehicles Act, 1988. Three such cases are the subject matter of this judgment.
നിഷ്ഠൂരമായ മൂന്ന് ഉദാഹരണങ്ങൾ (The Three Grim Tales)
എറണാകുളം എച്ച്ഡിഎഫ്സി ബാങ്ക് ജീവനക്കാരൻ
35-വയസുള്ള ബാങ്ക് ജീവനക്കാരനെ അങ്കമാലി-ആലുവ റോഡിൽ രാത്രി 8:30 ന് ഒരു എക്സ്യുവി (XUV) കാർ ഇടിച്ചുവീഴ്ത്തി. സിസിടിവികൾ ഉണ്ടായിട്ടും ടെക്-സാവി എന്ന് അവകാശപ്പെടുന്ന പൊലീസിന് വാഹനം കണ്ടെത്താനായില്ല. നട്ടെല്ലിന് ഗുരുതര പരിക്കേറ്റ യുവാവ് ചികിത്സയ്ക്കായി 20 ലക്ഷത്തിലധികം രൂപ ചിലവഴിച്ചു.
തിരുവനന്തപുരം കല്ലമ്പലത്തെ കല്ലാശാരി
60-വയസുള്ള മാൻസൻ (Mason), വീട്ടിലെ ഏക വരുമാനക്കാരൻ, 31.08.2025 ന് രാത്രി സ്കൂട്ടറിൽ പോകുമ്പോൾ അജ്ഞാത വാഹനം ഇടിച്ചു മരിച്ചു. കല്ലമ്പലം പൊലീസിന് തുമ്പൊന്നും ലഭിച്ചില്ല. ഭാര്യ ഗീത ഭർത്താവിന്റെ ജീവൻ അപഹരിച്ച അപകട ദൃശ്യങ്ങളടങ്ങിയ പെൻഡ്രൈവ് കോടതിയിൽ സമർപ്പിച്ചു.
കടവന്ത്രയിലെ 24-കാരിയായ യുവതി
പകൽ വെളിച്ചത്തിൽ കടവന്ത്ര-പനമ്പിള്ളി നഗർ റോഡിൽ സ്കൂട്ടർ ഓടിച്ചുപോയ യുവതിയെ ഒരു മോട്ടോർ സൈക്കിൾ യാത്രികൻ ഇടിച്ച് തെറിപ്പിച്ചു കടന്നു കളഞ്ഞു. മുഖത്തെ അസ്ഥികൾ തകർന്നു, പല്ലുകൾ കൊഴിഞ്ഞു. നിയമപാലകരെ വെല്ലുവിളിച്ചു കൊണ്ട് പ്രതി ഇപ്പോഴും ഒളിവിൽ കഴിയുന്നു.
ആഗോള മാതൃകകൾ നടപ്പിലാക്കണം (Follow Australia & UK Systems)
ഭരണകൂടത്തിന്റെ ധനപ്രതിസന്ധി ന്യായീകരണമല്ലെന്ന് ഹൈക്കോടതി വിധിയിൽ ചൂണ്ടിക്കാട്ടി. ഓസ്ട്രേലിയയിലേയും ഇംഗ്ലണ്ടിലേയും വിജയകരമായ മാതൃകകൾ പഠിക്കാൻ കോടതി കേന്ദ്രത്തോട് ആവശ്യപ്പെട്ടു:
1. Australia MAIA: ‘Nominal Defendant Fund’ രൂപീകരിച്ച് ലൈസൻസ് ഫീസ്, പിഴ എന്നിവയിൽ നിന്നും ഫണ്ട് സ്വരൂപിച്ചു രജിസ്ട്രേഷൻ ഇല്ലാത്തതും കണ്ടെത്താനാവാത്തതുമായ വണ്ടികൾ വരുത്തുന്ന നഷ്ടം നികത്തുന്നു.
2. United Kingdom MIB: എല്ലാ ഇൻഷുറൻസ് കമ്പനികളുടെയും പങ്കാളിത്തത്തോടെ ‘Motor Insurers’ Bureau’ നിർമ്മിച്ചു അജ്ഞാത ഡ്രൈവർമാർ വരുത്തുന്ന അപകടങ്ങൾക്ക് പരിഹാരം കാണുന്നു.
സുപ്രീം കോടതി നിർദ്ദേശങ്ങൾ ലംഘിക്കപ്പെടുന്നു
രാജശേഖരൻ.S കേസിൽ [AIR 2024 SC 583] സുപ്രീം കോടതി നൽകിയ 10 കൽപനകൾ അനുസരിക്കാൻ സർക്കാരിന് ബാധ്യതയുണ്ട്. അജ്ഞാത വാഹന അപകടങ്ങളിൽ നഷ്ടപരിഹാര തുക മരണത്തിന് 2 ലക്ഷവും, ഗുരുതര പരിക്ക് ഉള്ളവർക്ക് 50,000 രൂപയുമാണ്. ഈ തുക കാലോചിതമായി വർദ്ധിപ്പിക്കാൻ കേന്ദ്ര സർക്കാർ തയ്യാറായിട്ടില്ല എന്നത് ഖേദകരമാണ്. സുപ്രീം കോടതി നിർദേശിച്ച പ്രകാരം ജില്ലാതലത്തിൽ Monitoring Committee സജീവമാക്കേണ്ടതുണ്ട്.

സംസ്ഥാനത്തെ എല്ലാ ജില്ലകളിലും ഹിറ്റ് ആൻഡ് റൺ കേസുകൾ അന്വേഷിക്കാൻ ജില്ലാ പോലീസ് മേധാവിമാരുടെ കീഴിൽ “പ്രത്യേക സ്ക്വാഡുകൾ (Special Squads)” രൂപീകരിക്കണം.

ഈ സ്ക്വാഡുകൾ പരസ്പരം ഏകോപിപ്പിച്ചു പ്രവർത്തിക്കണം. സൈബർ ക്രൈം പോലീസ് ടീം ഇവരുടെ അഭ്യർത്ഥനകൾക്ക് പ്രഥമ പരിഗണന നൽകി സാങ്കേതിക സഹായം ചെയ്യണം.

സ്ക്വാഡുകളുടെ ഫോൺ നമ്പറുകൾ പൊതുജനങ്ങൾക്ക് ലഭ്യമാക്കി വൻ ജനകീയ ബോധവൽക്കരണം ഉറപ്പാക്കണം, അപകടം കണ്ടവർക്ക് ഉടൻ വിവരം അറിയിക്കാൻ സാധിക്കണം.

കേന്ദ്ര സർക്കാർ നഷ്ടപരിഹാര സ്കീം പരിഷ്കരിക്കണം. കോടതികൾ വഴി അജ്ഞാത എതിർകക്ഷികൾക്കെതിരെ കേസ് നടത്തിയും ഇൻഷുറൻസ് ഫണ്ടുകൾ വഴിയും ഇരകൾക്ക് വലിയ തുക ഉടൻ ലഭ്യമാക്കാൻ നിയമ ഭേദഗതി ആലോചിക്കണം.
